Terms & conditions : Enjoy Education Limited
Below are the basic terms and conditions which parents or guardians (the “Parents”) and Enjoy Education Limited (the “Company”) agree to when a child (“Pupil”) is enrolled for any tuition services (“Tuition”) and under which the tutor (“Tutor”) will provide Tuition to the Pupil.
1. The Parents shall pay the hourly rate as agreed and which shall be displayed on the Company’s invoice for each hour of Tuition that the Tutor provides (“the Hourly Rate”).
2. In the event that two Pupils are taught simultaneously, the Hourly Rate shall increase by 50%.
3. The Company shall charge the Parents a one off placement fee per request for a Tutor. This fee shall be equivalent to the cost of one hour’s tuition (“the Placement Fee”) and VAT will be added to the fee at the prevailing rate.
4. For residential placements (where the Tutor shall be staying under the Parents’ care whilst providing Tuition), 50% of the fee due shall be payable as a deposit at least one week in advance of the placement start date.
5. If the Tutor has to stop providing Tuition for any reason, the Company shall use its reasonable endeavours to provide another tutor at no additional cost to the Parents as soon as possible.
6. The Parents agree to check and sign the record of hours that the Tutor shall bring to each lesson.
7. The Company shall invoice the Parents on behalf of the Tutor at the end of each calendar month for the Tuition provided along with any Placement Fee and any other sums due under this agreement, payment of which shall be made to the Company within 7 days of receipt of such invoice.
8. Any sums due under this agreement must be paid directly to the Company, via cheque payable to ‘Enjoy Education Limited’ or by inter-account transfer to the Company’s bank account.
9. The minimum duration of a tutoring session is one hour.
10. The Parents shall approve any books or materials purchased by the Tutor for the Pupil.
11. Interest shall be charged on any payment which is outstanding for more than 14 days. The Company shall be entitled to charge 1% per month compound interest on all outstanding sums from the due date until payment is received by the Company.
12. The Company reserves the right to change the rates at any time provided that the Company shall give the Parents prior notice of such change.
13. The Tutor shall be responsible for all travel expenses within London travel zones 1 and 2 incurred in connection with the Tuition. If the Parents require the Tutor to travel to a location outside of these zones, the Parents agree to pay all travel expenses on presentation of appropriate receipts.
14. For residential placements, the Parents shall be expected to provide bed and board for the Tutor free of charge as well as cover all travel expenses including plane fares, petrol and accommodation costs.
15. The Company appreciates the importance of a good personal understanding between the Tutor and the Pupil. Accordingly, if the Parents or the Pupil are not happy with the Tutor after the first session, we will be happy to arrange for a new Tutor. The Parents must notify the Company of their dissatisfaction within 72 hours of the end of the first session to ensure that there will be no charge. The Company will then arrange for a change of Tutor.
16. In the event a Tutor cancels a lesson, then no fee shall be charged for that lesson.
17. Subject to clause 18 below, in the event the Parents cancel a lesson with the Tutor less than 24 hours in advance thereof, then the full fee shall be payable. The Parents agree to cancel the lesson by telephoning the Tutor.
18. A residential placement or enrolment on a course can be reserved via email or telephone and both of these constitute a confirmed booking.
19. In the event the Parents cancel a residential placement or enrolment on a course with less than 7 days’ notice, the full fee shall be payable.
20. In the event the Parents wish to recommend a Tutor sourced through the Company to their friends, the Parents agree to recommend the Company not the Tutor. This enables the Company to monitor performance and ensure the best tuition.
21. Further to clause 19 above, the Parents shall agree to make no private arrangements with the Tutor for lessons taught to members of their family, friends or any third party.
22. The Company has notified the Information Commissioner about the processing of its clients’ and Pupils’ personal data, as defined in the Data Protection Act 1998. The Company will use the information given by the Parents about the Parents and the Pupil(s) to provide the Pupil(s) with a suitable Tutor. The Parents agree that the Company may disclose the Parents’ and the Pupil’s personal data to potential Tutors.
23. The Parents agree to keep confidential all personal details concerning the Tutor which are passed to the Parents by the Company.
24. The Tutor shall not be held responsible for chaperoning or caring for minors or guarding a property and household effects whilst providing Tuition to a Pupil.
25. The Parents agree to treat the Tutor in a fair and respectable manner at all times.
26. The Parents acknowledge that the Company does not make any guarantees regarding the Pupil’s future academic performance or exam success.
27.1 Clauses 27.2 to 27.4 describe the full extent to which the Company will be liable to the Parents in respect of any legal claim that the Parents may choose to bring against it. For the purposes of Clauses 27.2 to 27.4 the term "the Company" shall mean the Company and its employees, agents, any Tutors and sub-contractors.
27.2 Nothing in these Conditions limits or excludes the liability of the Company (a) for death or personal injury resulting from negligence; or (b) for any damage or liability which results from any fraud or fraudulent misrepresentation by the Company.
27.3 Except where described at Clause 27.2, and in so far as it can, the Company excludes all liability for any loss or damage caused by the Company howsoever that damage is caused.
27.4 Except where described at Clause 27.2, where the Company is liable to the Parents for any losses, the Company's liability shall be limited to a refund of the sums that the Parents have paid for the Tuition.
28. Either party may terminate this Agreement by giving the other party at least one month’s prior written notice.
29. The Company may (at its discretion) terminate this Agreement forthwith or withhold further Tuition if any payment is outstanding for more than 28 days.
30. If the Parents have any reason to issue a complaint against the Tutor and/or the Company, the Parents must do so in writing (which includes email correspondence) as soon as possible and, in any event, within seven days of the incident giving rise to the complaint.
31. This Agreement is governed by the laws of England and Wales and subject to the jurisdiction of the courts thereof.
